These Terms of Service ("Terms") govern your access to and use of SafariFlow, a software-as-a-service platform operated by Advantage Online LTD, a company registered in Kenya ("we," "our," or "us").

1. Acceptance of Terms

By creating an account, accessing, or using SafariFlow, you agree to be bound by:

• Our Data Processing Agreement

2. Service Description

SafariFlow provides:

• Tour operations management software
• Customer relationship management (CRM)
• Booking and itinerary systems
• Supplier and fleet management tools
• Financial and reporting capabilities

3. Account Registration & Eligibility

3.1 Eligibility

To use SafariFlow, you must:

• Be at least 18 years old
• Represent a business entity authorized to enter contracts
• Have legal capacity to agree to these Terms
• Provide accurate and complete registration information

3.2 Account Security

You are responsible for:

• Maintaining account confidentiality
• All activities under your account
• Immediately notifying us of unauthorized access

4. Subscription & Payment

4.1 Free Trial

We offer a 14-day free trial requiring payment method registration. Card details are collected but not charged during the trial. You may cancel before the trial ends to avoid charges.

4.2 Subscription Plans

Available plans: Starter, Professional, and Enterprise. Pricing details on our Pricing Page.

4.3 Billing & Renewals

• Subscriptions renew automatically (monthly or yearly)
• Payments processed by Lemon Squeezy
• Prices subject to change with 30 days' notice
• All fees in USD unless stated otherwise

5. Data Ownership & License

5.1 Your Data

You retain all rights to data you input into SafariFlow ("Customer Data"). Customer Data includes:

• Client information
• Booking details
• Itineraries
• Supplier contracts

5.2 License to Us

You grant us a limited license to use Customer Data solely to provide SafariFlow services, including storage, processing, and transmission.

5.3 Our Intellectual Property

SafariFlow software, trademarks, logos, and documentation remain the exclusive property of Advantage Online LTD.

6. Service Availability & SLA

7. Prohibited Activities

See our Acceptable Use Policy. Violations may result in account suspension or termination.

8. Termination

8.1 By You

You may cancel your subscription at any time through the billing portal. Access continues until the current billing period ends.

8.2 By Us

We may suspend or terminate your account if you:

• Breach these Terms
• Fail to pay subscription fees
• Engage in prohibited activities

8.3 Data Export

Upon termination, you have 30 days to export your data. After this period, data will be permanently deleted.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY KENYAN LAW:

• SafariFlow is provided "AS IS" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to fees paid in the 12 months preceding the claim
• We are not responsible for data loss due to user error

10. Indemnification

You agree to indemnify and hold harmless Advantage Online LTD from claims arising from:

• Your use of SafariFlow
• Violation of these Terms
• Customer Data you provide

11. Governing Law & Dispute Resolution

11.1 Kenyan Law

These Terms are governed by the laws of the Republic of Kenya, excluding conflict-of-law principles.

11.2 Jurisdiction

Any disputes shall be resolved in the courts of Nairobi, Kenya.

11.3 Arbitration (Optional)

Parties may mutually agree to arbitration under the Nairobi Centre for International Arbitration (NCIA).

12. Changes to Terms

We may modify these Terms with 30 days' notice. Continued use after changes constitutes acceptance. Material changes affecting payments or data processing will require explicit consent.
